Services

The primary purpose for which Quartux processes your personal data is to provide the services derived from any service agreement you enter into with Quartux; any service related to the use of energy storage systems, applications, software, websites, and functionalities of your terminal equipment and/or any other services you voluntarily decide to acquire (hereinafter collectively referred to as the “Services”).

Categories of Personal Data Subject to Processing

For the provision of our Services and to comply with the purposes described in this Privacy Policy, Quartux must process the following personal data:

Personal Data Derived from the Services

Quartux will process the following categories of personal data: identification and authentication data, contact data, financial and/or patrimonial data, tax data, demographic data, device location data, network and traffic data, and data related to your preferences.

Indirect Sources of Personal Data Collection

In cases where Quartux has a lawful basis, it may obtain information related to you through the following sources:
(i) communications of personal data from affiliated companies (for purposes of this Privacy Policy, “affiliate” means any company that directly or indirectly controls, is controlled by, or is under common control with the specified company), subsidiaries and/or parent entities of Quartux (“Group Companies”);
(ii) third parties with whom Quartux has entered into commercial agreements that provide information related to you, including credit reporting agencies; and
(iii) information obtained from publicly accessible sources.

Obtaining information through these sources helps improve the services we provide and enables us to comply with the primary and secondary purposes described in this Privacy Policy.

Personal Data of Third Parties

Quartux may process identification and contact data of third parties when you provide such information so that those third parties may be contacted as personal references for collection purposes and/or for conducting investigations and periodic monitoring of your credit history, as well as for validating the information you provide. By providing this information, you acknowledge that you have informed such third parties about the use of their data and have obtained their prior consent for Quartux to process it for the purposes described above.

Quartux may obtain identification and authentication data of third parties authorized by the data subject to carry out various procedures related to the Services on their behalf. Such data will be retained for potential future acquisition of Services.

Quartux does not directly collect information from minors. If necessary, such information must be provided by a parent, guardian, and/or person with parental authority. If Quartux identifies that a minor has provided personal information without the consent of the person exercising parental authority, Quartux will proceed to delete such information.

Primary Purposes of Processing

Quartux will process the personal data described in this Privacy Policy to carry out one or more of the activities necessary for the development and fulfillment of the obligations arising from the Services, including the following purposes:

To verify and authenticate your identity in accordance with our procedures and policies, including verification of voter identification data and fingerprint similarity before the National Electoral Institute (INE).
To contact you via phone calls, emails, text messages, and other physical and/or electronic means of communication, as well as through home visits, for matters related to the use and management of the Services and to inform you of any benefits derived therefrom. Quartux may also contact you and your contacts and/or references to validate the quality of the information provided and/or to carry out collection activities.
To prepare analyses and studies related to your consumption behavior, as well as investigations and periodic monitoring of your credit behavior, including providing information to the corresponding credit reporting agencies.
To carry out billing activities and process payments through the methods enabled by Quartux related to the use of the Services and/or goods and/or services provided by third parties.
To carry out activities related to registration, cancellation, changes, and/or portability of Services, equipment, and plans in accordance with the terms of use of the Services.
To manage and offer goods and/or services and/or applications of Quartux, third parties, and/or Group Companies.
To generate reports, forecasts, and analyses related to the use and quality of the Services.
To address and follow up on investigations and reviews of complaints and/or claims related to the detection, prevention, and combating of conduct that may violate applicable regulations and/or the Services offered.
To maintain the security of electronic communications networks and services, detect failures or technical errors in electronic communications transmission, and carry out any processing necessary for the proper provision of telecommunications services or other applicable sector regulations.
To generate and carry out dissociation procedures to create segmented audiences so that third parties, business partners, and/or Group Companies may offer products and services.

Secondary Purposes of Processing

Quartux may process your personal data for one or more of the following secondary purposes:

To inform you about the launch or changes of new products, goods, services, promotions, and/or offers of Quartux, Group Companies, and/or business partners, according to your interests, through phone calls, emails, text messages, and other physical and/or electronic means.
To perform large-scale data analysis techniques for profiling activities by combining information provided by you, information obtained from publicly accessible sources (including social networks), and information inferred or obtained through data analysis technologies, in order to contact you and send advertising, promotional, and/or informational content that we believe may be of interest to you.
To generate consumption profiles and habits so that business partners may contact you and send advertising, promotional, and/or informational content they consider relevant and/or evaluate, according to their internal procedures, whether you are eligible to obtain the service requested from such third parties.

If you do not wish Quartux to process your personal data for any of the purposes described in this section, please send an email to ventas@quartux.com. You may change your preference at any time.

Please note that if you grant your consent, it will remain valid even after the legal relationship between you and Quartux has ended, meaning Quartux may continue processing your personal data necessary to fulfill these secondary purposes.

Transfers

Transfers Not Subject to Consent

Quartux may transfer your personal data to national or foreign entities without requiring your consent in the following cases:

Competent authorities and third parties in legally established cases.
To the National Electoral Institute (INE) for identity validation and authentication purposes.
To credit reporting agencies, bonding companies, and insurers to ensure compliance with obligations derived from the Services.
To Group Companies so they may contact you, directly or indirectly, to promote and/or offer products and/or services marketed jointly or independently with Quartux, under privacy policies compliant with applicable regulations.
To third parties authorized by you to receive information related to the Services.

Transfers Requiring Consent

Unless you object, Quartux may transfer your personal data to business partners and/or third parties, including banking institutions, so they may contact you to offer goods and/or services of interest or determine whether you are eligible to acquire such goods and/or services.

If you do not wish Quartux to carry out such transfers, please send an email to ventas@quartux.com. You may change your preference at any time.

Means and Procedure to Exercise ARCO Rights and/or Revoke Consent

Your request must be submitted through the Unified Form for the Exercise of ARCO Rights, Revocation of Consent, and/or Limitation of Use or Disclosure of Personal Data (the “Form”), available on the website https://quartux.com/política-de-privacidad. The Form contains all required elements to process your request in accordance with applicable regulations.

If the information provided in the Form is incorrect or insufficient, or if the required supporting documents are not attached, Quartux’s Personal Data Department may request additional information within five (5) business days of receipt. You will have ten (10) business days to respond. Failure to respond within this period will result in the request being deemed not submitted.

Limitation of Use or Disclosure of Personal Data

You may limit the use or disclosure of your personal data by submitting a request to Quartux’s Personal Data Department at ventas@quartux.com. Identity verification requirements and procedures will follow the same criteria described above.

If you deem it necessary, you have the right to file a complaint with the National Institute for Transparency, Access to Information and Protection of Personal Data (INAI) regarding the processing of your personal data by Quartux.

Quartux reserves the right, at its sole discretion, to modify, amend, add, or remove portions of this Privacy Policy at any time.
